By using mobilelyft's platform or services, you agree to these legally binding terms. This agreement governs every transaction conducted through our website, app, and doorstep buyback operations across Pakistan. Please read carefully before proceeding.
1. Acceptance of Terms & Legal Definitions
These Terms and Conditions ("Agreement") constitute a legally binding contract between you ("Seller" or "User") and mobilelyft, a Pakistani e-commerce platform specialising in used smartphone buyback and resale. By accessing or using our platform in any manner, you acknowledge that you have read, understood, and agree to be bound by this Agreement without modification.
Any mobile phone, smartphone, or tablet submitted or offered for sale via mobilelyft.
The preliminary, non-binding price estimate generated by mobilelyft's online tool based on your self-reported device condition.
The verified, legally binding price offered after physical QC inspection by a mobilelyft-certified technician.
2. Seller Eligibility & Representations
To use mobilelyft's sell phone service, you must meet all of the following statutory requirements:
You must be at least 18 years of age and present a valid CNIC (Computerised National Identity Card) or Pakistani Passport to complete any transaction.
You must be the sole legal owner of the Device with unencumbered title — meaning the device is not subject to any outstanding EMI installments, undisclosed financing, or third-party ownership claims.
You confirm that the Device has never been reported stolen, lost, or blocked by any mobile network operator or government authority.
You declare that all information provided — including device condition self-assessment, ownership status, and IMEI — is truthful, accurate, and complete. Wilful misrepresentation may constitute fraud under PECA 2016 §9.
Minors (under 18) are strictly prohibited from transacting independently. A legal guardian may transact on their behalf, assuming full legal responsibility for the transaction.
3. Device Grading & Valuation
mobilelyft uses a standardised, transparent four-tier grading system to determine your device's Final Buyback Value during doorstep QC inspection:
Screen, body, and internals in pristine, factory-equivalent condition. No scratches, cracks, or functional faults.
Minor surface wear (light hairline scratches). All functions fully operational. Battery ≥ 80%.
Visible scratches, minor cosmetic damage, or battery 60–79%. Core functions (calls, data, camera) working.
Cracked screen, major physical damage, or one or more critical functions not working. Device accepted at reduced value.
4. Doorstep Logistics & QC Protocols
The registered seller (CNIC holder) must be physically present at the agreed pickup address during the doorstep visit. Third-party handover is not permitted unless pre-authorised in writing by mobilelyft support.
The device must have a minimum 30% battery charge at time of inspection. All personal accounts (Google, iCloud, Samsung Account) must be signed out and "Find My Device" / "Activation Lock" disabled prior to the technician's arrival. Failure to do so will result in rescheduling.
You are solely responsible for backing up and securely erasing all personal data from the device before the doorstep visit. mobilelyft is not liable for any data loss or privacy breach arising from data remaining on a sold device.
Ownership of the device irrevocably transfers to mobilelyft upon your acceptance of the Final Buyback Value and physical handover of the device to the technician. This transfer is final and cannot be reversed.
Doorstep service is currently available in Faisalabad, Lahore, Karachi, Islamabad, Rawalpindi, and Gujranwala. Users outside these areas may ship devices via designated courier with prior arrangement — additional terms apply.
5. PTA DIRBS Compliance & Legal Repercussions
mobilelyft maintains a zero-tolerance policy for stolen, counterfeit, or blacklisted devices.
Every device submitted to mobilelyft is subject to a real-time IMEI verification against the PTA's Device Identification Registration and Blocking System (DIRBS) database, which flags stolen, counterfeit, and PTA non-compliant devices.
If a device is flagged as stolen, non-PTA compliant, or carrying a cloned/patched IMEI, mobilelyft will immediately refuse the transaction and may confiscate the device as evidence per PTA Device Regulations 2018.
mobilelyft reserves the right to report suspected stolen devices or fraudulent sellers to the Federal Investigation Agency (FIA) Cybercrime Wing and the Pakistan Telecommunication Authority without prior notice.
The seller bears full legal and financial liability for any adverse consequences — including criminal prosecution — arising from the submission of a stolen, encumbered, or IMEI-tampered device.
6. Payment Terms & Statutory Taxation
All payments by mobilelyft to sellers are subject to the following terms:
Withholding tax is deducted at source under Section 153(2A) of the Income Tax Ordinance 2001, as amended by S.R.O. 1429(I)/2025 of the FBR Finance Act 2025-26. The deducted tax is remitted directly to the FBR on your behalf.
A formal tax deduction certificate is provided with every transaction. Filers may claim this as an adjustable tax credit when filing their annual income tax return (Form IT-1).
mobilelyft does not issue or accept physical cash payments exceeding Rs. 50,000 in a single transaction, per FBR's documentation requirements. All high-value transactions are conducted via digital channels only.
Payment is made only after a positive DIRBS IMEI check, successful completion of physical QC inspection, and seller acceptance of the Final Buyback Value.
7. Limitation of Liability
mobilelyft's total aggregate liability to any seller or user, regardless of cause or legal theory, shall not exceed the Final Buyback Value of the specific device involved in the dispute.
This limitation applies to the maximum extent permitted by applicable Pakistani law, including:
Indirect, incidental, or consequential loss
Loss of profits, revenue, or business opportunity
Data loss or device data compromise
Delays in logistics caused by third-party couriers
Market price fluctuations between quote and inspection date
Service interruptions due to force majeure events
8. Indemnification
You agree to fully indemnify, defend, and hold harmless mobilelyft, its directors, employees, agents, and technology partners from and against any and all claims, damages, fines, penalties, or legal costs arising from:
- Your breach of any provision of this Agreement
- Submission of a stolen, counterfeit, or IMEI-tampered device
- False ownership declarations or fraudulent representations
- Violation of any applicable Pakistani law, including PECA 2016, PTA regulations, or FBR tax obligations
- Infringement of any third-party rights in connection with your use of mobilelyft's platform
9. Unilateral Modification of Terms
mobilelyft reserves the right to amend, update, or modify these Terms and Conditions at any time without prior notice, subject to the following communication obligations:
Material Changes: Published prominently on the platform with 30-day advance notice.
Email Notification: Sent to your registered email address for changes affecting payment terms or legal liability.
Effective Date: Each version is dated; the most recent Effective Date controls in case of conflict.
Continued Use = Acceptance: Using mobilelyft after any change constitutes your binding acceptance of the revised terms.
10. Governing Law & Dispute Resolution
This Agreement is governed by and construed exclusively in accordance with the laws of the Islamic Republic of Pakistan, including the Contract Act 1872, Sales of Goods Act 1930, PECA 2016, and all applicable PTA and FBR regulations.
Both parties agree to attempt informal dispute resolution in good faith before initiating formal proceedings. Contact our support team at support@mobilelyft.shop. We commit to an initial response within 72 hours.
For consumer disputes not resolved informally, the appropriate forum is the Provincial Consumer Court in the province where the transaction occurred (Consumer Protection Act 2019 — Punjab, Sindh, KPK, Balochistan).
Commercial disputes (exceeding Rs. 500,000) shall be resolved through binding arbitration under the Arbitration Act 1940, with proceedings conducted in Faisalabad, Punjab, Pakistan. Arbitration shall be in the English or Urdu language.
All disputes must be brought on an individual basis. Class actions, collective proceedings, or representative claims are not permitted under this Agreement.
